These Terms and conditions (the “terms”) apply when you as a consumer (“you”) make an order through usa.maussafety.com and related pages, (the “website”). The terms and conditions constitute an agreement between you and MAUS USA, LLC, (“MAUS USA” or “we”).
The terms are applicable only to consumers who make orders through the website. We ask you to carefully read the terms and conditions before further use of the site.
By making purchases from and using this website, you agree to the following terms and conditions.

To be able to order on the website you must be at least 18 years old. MAUS USA does not accept credit purchases to persons under the age of 18. We reserve the right to refuse or modify your order in individual cases (for example, if you have provided inaccurate personal data and/or have a credit history).

MAUS USA reserves the right to end sales and any image and typographical errors on the website, such as defects in product description or technical specification, incorrect prices and price adjustments (such as changes in prices from suppliers or Currency fluctuations) or incorrect information regarding whether an item is in stock. MAUS USA has the right to correct any such errors and to change or update the information at any time. If an incorrect price has been set for an order you have ordered, we will of course notify you of this and await your acceptance of the corrected price before proceeding with the order. All image information on the website should be seen as illustrations only. Such illustrations cannot be guaranteed to reproduce the number of goods you obtain or the exact appearance, features or origin of the product.

The website, as well as all its contents, are owned by MAUS USA or its licensors. The information is protected by, among other things, intellectual property law and market law. This means that trademarks, trade names, product names, images and graphics, design, layout and information about goods, services and other content may not be copied or used without the prior written consent of MAUS USA.

When you shop on our website, we will store some of your personal information in order for you to complete your purchase. You have the right to request access to your data and if any information is inaccurate, you may have it changed or removed. PRICES, FEES AND PAYMENT

Once we have received an order from you, we will send a confirmation to your email address. It is therefore important that you enter the correct information when you make an order. We recommend that you save the confirmation to facilitate any contact with our customer service. The confirmation is also your receipt that you have completed the purchase.

You can choose to pay by bank, credit card or by invoice. MAUS USA has the right to charge already in connection with the order, unless the invoice payment or other similar payment method is chosen by you and approved by MAUS USA. In case of invoice payment or partial payment, our partner may make a credit report. In this case, you will be informed of this. MAUS USA reserves the right not to always offer all payment methods, or change the payment method if what you have chosen for any reason does not work at the time of purchase. Please note that any restrictions on payment options are stated on the website.

MAUS USA may offer promotions on the website which have more favorable terms than those set out in these terms and conditions, such as: Discounts or extended right of withdrawal. These more favorable conditions apply as long as the promotion is active and for the specific goods specified by MAUS USA in connection with the promotion. We reserve the right to revoke such promotions at any time. Upon termination or revocation of a promotion, these Terms and conditions shall apply without modification. Offers on specific items on the website are valid for a limited time and while stocks last.

DELIVERY AND CANCELLATION

Goods in stock are normally delivered within the number of working days indicated on the website. Unless otherwise specifically agreed, e.g. In connection with the booking of goods that are not stocked.

You have the right to cancel an order if it has not been sent.
If you feel that the delivery of an item is unusually delayed, which means that you no longer wish to make the purchase, it is your responsibility to cancel your order. MAUS USA’s liability for defects in connection with delivery is limited in accordance with the applicable delivery terms for the current delivery and what follows from these terms and conditions.
Our liability to you for any losses or damages arising in connection with your order on the site is limited to the total amount of your order. MAUS USA has no liability for indirect losses.

RIGHT OF WITHDRAWAL AND RIGHT OF EXCHANGE

You have the right to replace one/all products that you have purchased directly from our website within 14 days of receiving the product.
The product should be in the same mint condition as when it was received. The product should also be in its original packaging with intact labels and protective stickers.
A product can only be exchanged for a product of the same or lower value. If you want to switch to a more expensive product, a return must be made and we will issue a full refund. After this you can if you wish to place a new order for the right product.

Products purchased directly from our site must be returned to our warehouse for a replacement to be made. The products cannot be exchanged in a local store.
Please note that you may have to pay the freight for the return package. However, MAUS USA pays the shipping costs when the new product is sent to you.

You always have 14 days right of withdrawal from the date of receipt of the goods. We will refund any goods that have not been used or are in substantially unchanged condition.
MAUS USA will pay the amount as soon as possible, but no later than 14 days from the date we received your notice of exercise of the right of withdrawal. However, MAUS USA may wait for the refund until we have received the goods or you have shown that the goods have been returned, for example. Through a submission receipt.
The refund will be made to you via the payment option chosen by you, provided that nothing else is agreed or that there are obstacles to such reimbursement
Please note that if you have chosen to pay by invoice, the 14 days on the invoice will start from the day the package is sent from us. You are liable for payment during the entire return or exchange process.

WARRANTY AND COMPLAINT

MAUS USA’s guarantee for MAUS Xtin Klein and MAUS Xtin Grand is 5 years from the date of production (see labeling on device). For MAUS Dekke, Nozzle Klein and Holster Klein the warranty is 3 years from the date of purchase. If Nozzle Klein is used, it is not considered a warranty case. The EGO series has a 3 year warranty from the date of purchase, the products are manufactured to meet our high quality standards, in addition to the products covered by our warranty against any manufacturing defects. MAUS USA’s warranty covers only the parts mentioned above. To report a warranty case, please contact customer service.

Please note that MAUS USA’s warranty does not cover:

• Defects and damage caused by loss, theft, fire or water.
• Defects or damage caused by misuse, negligence (beats, dents, crushing injuries, falls, etc.), accidents or improper repair or modification.
• Aesthetic changes, defects and injuries due to normal wear and tear and aging (e.g. minor scratches, wear of leather and flaked paint, etc.).
• Failure to comply with storage advice may void the warranty.

It is important that you as a customer carefully examine the product once you have received it. If your property is damaged during transport, you must report this as soon as possible to the carrier. This is true whether or not it is a visible injury. If, after receiving the goods, you find that it is damaged or does not correspond to the product you ordered, please contact us within 30 days.

Any complaints should be made to info@maussafety.com. Please provide us with your order number and the reason for your complaint and we will get back to you with further instructions on the return of the goods. Faulty products returned to us should be treated with care by the customer and as if they were error free. Regardless of the reason for return, it is of great importance that the product is packaged so that it cannot be damaged during transport. If a product is to be replaced, this is done against a product of the corresponding model. If a particular product no longer exists, the customer is entitled to a refund instead.

OWNERSHIP

All goods remain MAUS USA’s property until the full payment has been received by the company.

All fraud attempts are reported to the police. MAUS USA reserves the right to cancel a purchase if fraud is suspected.

FORCE MAJEURE

In the event of war, warlike event, Civil war, revolution, rebellion, government action, strike, lockout, blockade, natural disaster or similar event, technical problems, faults in electrical/telecommunication/data connections or other communications as well as errors or delay in the services of a subcontractor due to the circumstance stated here, MAUS USA will be able to apply for force majeure. Those circumstances shall constitute a basis for exemption from damages and other penalties. If this happens, we will try to inform the customer accordingly. In case of dispute, we naturally follow the decision of the General Complaints Board.

APPLICABLE LAW AND JURISDICTION

Nevada law applies to these Terms and your use of this website. To the extent permitted by law, the Nevada court shall have exclusive jurisdiction in respect of any dispute arising out of these terms or your use of the website, except for cases where MAUS USA voluntarily chooses to take legal action against a customer/ The user where it is domiciled.

CHANGES TO THE TERMS

MAUS USA reserves the right to make changes to these terms and conditions at any time. Any changes to these terms and conditions will be posted on the site. Changes apply from the acceptance of the terms (in connection with a new purchase or visit to the website), or 30 days after we have informed you of the changes. However, MAUS USA recommends that you keep updated on the website regularly to be aware of any changes to the terms.

INVALIDITY

If competent court, authority or arbitration tribunal would find that any provision of these terms is invalid or unenforceable, the provision in question and all other provisions shall be effective and enforceable to the extent that applicable law Allows.
